Spousal Insurance: Suing your Spouse in a Car Accident

Wed, Jul 29, 2009

Sometimes people are injured in a car accident due to the “fault” of their spouse. In those instances, if you are injured, you may not be able to make a claim against the driver of the other vehicle. Instead, in some circumstances, you may be able to make a claim against your spouse for causing the accident with your own insurance carrier. Few insurance policies have “spousal insurance” coverage. This coverage is an elective option under most policies and only few insurance carriers properly advise you as to your rights to elect this type of coverage. In the event that your policy has this important “spousal insurance” coverage, we may be able to bring a claim against your own insurance carrier for losses sustained including pain and suffering. Many times filing these claims will not affect your own insurance rates. It is important to review your policy to make sure spousal insurance is included if, in fact, you are married.
