Construction Accidents: Top New York Construction Accident Attorney

One of the most dangerous places, for even the most careful person, is the construction site. Equipment can malfunction. Required safety devices may fail and, in some cases, may not be properly provided. If you were injured while “on the job,” you will, in all likelihood, be eligible for Workers’ Compensation benefits. However, while this program may cover most of your medicals and some of your lost wages, it will almost certainly not provide enough money for all of the damages you may have sustained.

In New York State you cannot sue your employer or co-workers. Workers’ Compensation claims are your only rights against these individuals. However, Workers’ Compensation will not provide you 100% of your lost earnings. The maximum amount a worker is eligible to receive is extremely limited by State statute. In addition, the Workers’ Compensation Board may deny your claim or end your benefits pursuant to their own guidelines and regulations. Therefore, it is imperative that an injured party seeks recourse in the form of “Third Party Claims” (against the parties who are legally responsible for your accident). Even those workers who are “off the books,” are entitled to pursue both a Workers’ Compensation claim and a “Third Party Claim.” But, as with other personal injury lawsuits, you may lose all of your rights to a claim if you fail to act within a certain time period.

Navigating a claim involving Workers’ Compensation is tricky. You may lose all of your rights to medical and financial recovery if you ignore the requirement to file your claim even if your employer states he or she will pay for your medical bills out of his or her own pocket.

Lawsuits Against other Third Parties

You may be able to make a claim against a negligent party, other than your employer, if you were injured on a work site owned and/or operated by a party other than your employer. “Third Parties” can often be liable for construction site accidents. General Contractors, property owners, project or construction managers, and other workers at the site — even the City or State — can often be responsible for your injuries. There are specific regulations and codes providing for construction worker safety at the job site.

You may be eligible for compensation for more than just your physical injuries and the accompanying pain and suffering. Lost income (not covered by Workers’ Compensation), loss of pension, loss of future employment, loss of medical benefits, and loss of other rights or benefits can all be claimed — if filed in a timely and proper manner. It is imperative that you protect your rights by both proceeding with available Workers’ Compensation claims AND available third party claims against the parties responsible for your injury.

If you or a loved one suffered a serious injury as a result of a construction accident, it is necessary to file a personal injury claim now and to properly pursue the legal action needed to recover any compensation to which he or she is entitled.
